Chairman of Supreme Court of the Azerbaijan Republic Ramiz Rzayev took part at the international justice conference in Pakistan organized in the frame of actions dedicated to 50th anniversary of creation of Pakistan’s Supreme Court.

Participants of the action attended by chairmen of Supreme Courts and justice ministers of over 30 world countries, have focused a range of hot problems of global concern. At the conference, discussed was the role of justice in state administration, application of international norms on human rights, terrorism, human trafficking, the intellectual property rights and globalization, international arbitrage and others questions.

The Supreme Court of Pakistan is the apex court in the judicial hierarchy of the country. The Court is comprised of a Chief Justice and 16 Judges. The Constitution contains elaborate provisions on' the composition, jurisdiction, powers and functions of the Court. The qualifications for, and mode of appointment of Judges, age of their retirement, grounds and procedure for removal from office and terms and conditions of service of judges are also specified in the basic document. ...

Establishing a system of trichotomy of power, the Constitution assigns the Supreme Court a unique responsibility of maintaining harmony and balance between the three pillars of the State namely legislature, executive and judiciary. The purpose is to ensure that the state organs perform their respective functions under the stipulated limits and constraints. As guardian of the Constitution, the Court is required to "preserve, protect and defend' this document. its multiple roles include resolving conflicts and disputes, be they among governments (Federal/provincial) or between government and individual or individuals inter se. The Court is also a custodian and upholder of' citizens' rights, liberties and freedoms. Seen in this context, the Court indeed occupies a pivotal status 'and crucial position in the Constitutional dispensation, by playing the role of unifying and integrating the nation, its regions, institutions and communities.

It is indeed a great privilege to mark the 50th anniversary of the Supreme Court of Pakistan. It is a day to rejoice in humility for all those engaged in the dispensation of justice. It is a day of earnest deliberation, a day of reckoning and a day of re-dedication to the goals ahead.

“A moment of justice delivered is far valued than sixty nights of worship" said Prophet (P.B.U.H). The primary role of a Judge is to apply law with a view to provide justice to the parties before him. Justice has many dimensions. Human society is a living organism and subject to constant change. The law may not keep pace with the dynamics of social change. The role of a Judge in this context is to bridge the gap between law and society. Tampering the exercise of power is yet another dimension. Power is one of the basic human drives. It is needed to enforce the mandate of law, the writ of the State and the execution of a verdict delivered. Justicing here would mean reigning in the functionaries of the State who wield power. As Blaise Pascal aptly observed, “Justice without power is inefficient; power without justice is tyranny. Justice without power is opposed, because there are always wicked men. Power without justice is soon questioned. Justice and power must therefore be brought together, so that whatever is just may be powerful, and whatever is powerful may be just.”

The various facets of the application of law and dispensation of justice would bring relief to the wronged only if there is the requisite procedure, the desired will, undoubted integrity, unwavering courage and a dedication commensurate with the enormity of the task. This caveat constitutes a challenge both for the lawyers and the judges. The quality of the justice system would depend on how they respond to this challenge.

Jonah allowed onepence, who has an interest in news, to post various news articles here, but I think it gave some impression that the ideas may have been endorsed by Baha'is, etc. I don't think was reflecting even onepence's opinions.

I am not criticising onepence but the Supreme Court of Pakistan the two faced monkey institution.
